Please read these Terms of Service carefully before accessing or using our website. This website, available at https://rebelbrew.co, is operated by Phoenix Road Pty Ltd (ABN 28 675 187 649) trading as Rebel Brew. Throughout the site, the terms "we", "us" and "our" refer to Phoenix Road Pty Ltd trading as Rebel Brew. 1. Acceptance of Terms

By visiting our website and/or purchasing products from our Shopify-hosted store, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including those additional terms, conditions, and policies referenced herein or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, customers, merchants, or contributors of content.

If you do not agree to all the terms and conditions of this agreement, you must not access the website or use any of our services. If these Terms of Service are considered an offer, acceptance is expressly limited to these Terms of Service.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our premium coffee products and accessories to you.

2. Our Social Impact and Charitable Commitment

Rebel Brew is a premium coffee brand committed to driving positive global change. We proudly donate fifty percent (50%) of our net profits to highly effective charities. These donations are processed and distributed via Effective Altruism Australia (ABN 87 614 905 454), a registered Australian charity dedicated to directing funds to the world's most effective, evidence-based charity organizations.

For the purposes of this commitment, "net profits" are defined as gross revenues generated from the sale of Rebel Brew products on our website, less all direct and indirect operating expenses, including but not limited to:

  • Cost of goods sold (sourcing of premium coffee beans, roasting, and packaging);
  • Shipping, fulfillment, and third-party logistics costs;
  • Shopify platform hosting, transaction fees, and payment gateway processing charges;
  • Marketing, advertising, and customer acquisition costs;
  • Employee wages, contractor fees, and staffing costs;
  • Administrative, legal, accounting, and general overhead expenses; and
  • Applicable corporate taxes and government levies.

We maintain rigorous financial records, and our donation processes are reviewed regularly to ensure transparency, compliance, and alignment with our stated charitable objectives. Reports detailing our donation impact are published periodically on our website.

3. Account Registration and Security

While you may browse our website without an account, purchasing products or accessing certain premium features may require you to register for an account on our store. When creating an account, you agree to:

  • Provide accurate, current, and complete information as prompted by the registration forms;
  • Maintain and promptly update your account information to keep it accurate, current, and complete;
  • Maintain the confidentiality of your account credentials, including your password; and
  • Accept full responsibility for all activities, purchases, and actions that occur under your account.

There is no specific age restriction for purchasing our products; however, if you are under eighteen (18) years of age, you must obtain the consent of a parent or guardian before registering an account or making any purchases. We reserve the right to suspend or terminate accounts, refuse service, or cancel orders at our sole discretion if we detect or suspect unauthorized, fraudulent, or illegal activity.

4. Product Descriptions, Availability, and Pricing

We take extreme care to ensure that our premium coffee products, grind options, accessories, and descriptions are presented as accurately as possible. However, to the maximum extent permitted by law, we do not warrant that product descriptions, images, tasting notes, or other content on our website are completely error-free, complete, or current.

All prices displayed on our website are in Australian Dollars (AUD) and are inclusive of Goods and Services Tax (GST) where applicable. Shipping costs are calculated and displayed separately at the checkout stage prior to final purchase.

We reserve the right to modify prices, alter product formulations, or discontinue any product at any time without prior notice. In the event that a product is mistakenly listed at an incorrect price, we reserve the right to cancel any orders placed for the product listed at the incorrect price, even if the order has been confirmed and your payment processed. If your payment has already been processed and we cancel your order, we will immediately issue a full refund to your original payment method.

5. Payment Terms

Payment must be made in full at the time of placing an order through our Shopify checkout. We accept a variety of payment methods as supported by our secure checkout interface, including:

  • Major credit and debit cards (including Visa, Mastercard, and American Express);
  • Digital wallets (such as Apple Pay and Google Pay); and

By submitting payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us (or our secure third-party payment processor) to charge your payment method for the total amount of your transaction, including product costs, GST, and shipping fees.

We reserve the right to refuse, limit, or cancel any order that, in our sole judgment, appears to be placed by dealers, resellers, or distributors, or if we suspect fraudulent or unauthorized transaction activity.

7. Returns, Refunds, and Consumer Guarantees

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms of Service excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded.

Your Rights Under the Australian Consumer Law

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Type of Issue Definition under ACL Your Entitlement / Remedy
Major Failure The product is unsafe, differs significantly from its description, or is completely unfit for its normal purpose and cannot be easily fixed. You have the right to choose between a full refund or a product replacement.
Minor Failure The product has a small, easily rectifiable defect (e.g., minor external packaging damage that does not affect the coffee quality or freshness). We will, at our discretion, provide a replacement product or a partial/full refund within a reasonable time.

Change of Mind Policy

Due to the highly perishable nature of our premium coffee beans and ground coffee products, we do not offer refunds, returns, or exchanges for change of mind once an order has been dispatched. We encourage you to review your order details, selected grind profile, and quantity carefully before finalizing your purchase at checkout.

How to Request a Return or Refund

If you believe a product you received has a defect, has been damaged in transit, or does not comply with a consumer guarantee, please contact us immediately at hello@rebelbrew.co. To assist us in processing your request efficiently, please provide:

  • Your full name and order number;
  • A detailed description of the issue; and
  • Clear photographic evidence of the product, packaging, or defect.

We will assess your claim in accordance with the Australian Consumer Law and notify you of the outcome. If a return is required for assessment, we will provide instructions and cover the cost of return shipping for valid claims. For more information, please refer to our full Refund Policy at https://rebelbrew.co/policies/refund-policy.

We reserve the right, in our sole discretion and without liability to you, to terminate this agreement, suspend your access to our website, or close your customer account at any time without notice if we believe or suspect that you have failed to comply with any term, condition, or provision of these Terms of Service, or if we suspect any fraudulent, unauthorized, or illegal activity. Upon termination, you remain liable for all outstanding amounts due up to and including the date of termination.

The provisions of these Terms of Service which by their nature should survive termination shall survive termination, including but not limited to intellectual property rights, limitations of liability, governing law, and dispute resolution provisions.

14. General Provisions

  • Severability: If any provision or part of a provision of these Terms of Service is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision or part-provision will be severed from the remaining Terms, and the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
